7.1 30% down payment by T.T within 3 working days from date of this C/P.
30%的海运费作为保证金,在签完此合同 3天之内一电汇的方式打到船东的指定账户。
7.2 Exact carrying quantity to be determined by draft survey. total freight less 30% prepaid shall be paid through t/t within 2 banking days after completion of loading.
实际装运的数量由吃水检量决定。总运费扣除30%预付款在装货完成后的2个银行工作日内电汇支付。
7.3 Freight deemed earned once cargo on board, non-returnable, non-deductable, whether cargo/vessel lost or not.
一旦货物装船, 运费视为已赚取,不能返还, 不能折扣,无论货物/船舶灭失与否。
8. Loading rate: MT PWWD FSHINC
装货率:每个晴天工作 日吨,星期五、星期日和节假日包括在内。
Discharging rate: MT PWWD SSHINC
卸货率:每个晴天工作日 吨,星期六、星期日和节假日包括在内。
9. Demurrage: USD per day or pro rata. once on demurrage, always on demurrage. demurrage incurred at loading port to be paid through T/T within 2 banking days from completion of loading. demurrage incurred at discharge port to be paid through t/t within 3 banking days from completion of discharge.
滞期费:每天 美元,不足一天按比例计算。一旦滞期,永远滞期。装货港产生的滞期费在装货完成后的2个银行日内电汇支付。 卸货港产生的滞期费在卸货完成后的3个银行日内电汇支付。
10. Nor shall be tendered on vessel’s arrival at pilot station or quarantine anchorage of loading/ discharging port at any time day or night, Sunday & holiday included, whether in berth or not, whether free pratique or not, whether customs cleared or not.
就绪通知书在船舶到达装/卸港引水站或检疫锚地时提交,无论白天和黑夜,包括节假日和星期天,无论是否检疫,是否清关,是否靠泊。
11. Laytime calculation: laytime for loading and discharging shall commence 12 hours after tendering nor. time actually used before commencement and time lost in waiting for berth to be counted. separate laytime for loading and discharging.
装卸时间的计算:装卸时间在递交就绪通知书后的12小时开始起算。装卸时间开始前实际使用的时间和等泊位的时间计入装卸时间。装货与卸货时间分开计算。
12. Charterers guarantee that cargo, documents and gears shall be ready upon vessel's arrival at the port. otherwise, if loading not to be commenced 96 hours after vessel’s arrival because of above mentioned reasons, owners shall have the right to withdraw vessel and claim relevant loss.
租家保证船舶抵港时,货物、单证和装卸设备已备妥。否则,在船舶抵达装港48小时后,因为租家的上述原因仍不能进行装货作业,船东有权撤船,并索赔相关损失。
13. In absence of original BS/L at discharging port, master/owr/ owr’s agent shall allow cargo to be discharged against consignee or notify party’s letter of indemnity in owr’s standard p&i club wording without bank guarantee or endorsement.
如果正本提单在船舶到港之前不能到达卸货港,船长/船东/船东代理应允许凭收货人或通知方的按照船东互保协会格式的没有银行担保的保函卸货.
14. Taxes/dues on cargo to be for charterer’s account, same on vessel/freight to be for owner’s account.
因货物产生的税费由租家承担, 因船舶和运费产生的税费由船东承担。
15. Owners should advise charterer 5/3/2/1 days before arrival at loading/ discharging port.
在船到达装港或卸港前,船东需提前5/3/2/1天向租家通报船舶预抵动态。
16. Lighterage/lightering/shore crane/floating crane/shifting, if any, shall be for charterers’ time and account at bends.
如果在装卸港需要安排驳船/过驳/岸吊/浮吊/移泊,由租家承担时间和费用。
17.Oowrner’s agent at both ends. 装卸港代理由船东指定。
18. Disputes, if any, to be setteled at sub-commission of china maritime arbitration commission,English law to apply.
如发生争议,应在中国海事仲裁委员会广东分会解决,适用英国法。
19. On discrepancy between Enlish and Chinese, English to apply.
中英文如有差异,以英文为准。
20. Others as per GENCON94.其它未尽事宜依据金康合同94年版。

detention charges incurred at loading port, if any, to be settled together with freight payment and which incurred at discharging port, to be settled before commence of discharging.
滞留损失:如果船舶在双边港口因货物和/或单证未备妥而遭受船期损失,租船人应每日支付usd2500,不足一天按比例计算。
滞留损失费在装港发生的话,连同运费一起支付,若在卸港发生,则在卸货开始前支付。
8) FREIGHT:USD9/MT,FIOST,BASIS 1/1
运费:Usd9/Mt,Fiost(船东不管装,卸,理舱,平舱),一装一卸

LINER TERMS:由船东负责装卸。
FIO:FREE IN AND OUT,船东不管装,不管卸。
FIOST:FREE IN AND OUT,STOWED,TRIMMED,船东不负责装卸及理舱,平舱。
FILO:FREE IN LINER OUT,船东不管装管卸。
LIFO:LINER IN FREE OUT,船东管装不管卸。
9) Full freight WB paid to owrs nominated bank acct W/I 2 bank days ACOL N S/R Bs/L which marked ‘FRT PREPAID’. full freight to be deemed as earned with discountless and non-returnable on cargo shipped on board whether ship and/or cargo lost or not lost.
所有运费在装完货并签发预付运费提单后两个银行工作日内付至船东指定帐号。所有运费在装完货后即视为已赚取,不得扣减,无须返还,无论船舶和/或货物灭失与否。
10) Owrs agent bends.两边港口由船东指定代理。
11) L/S/D IF ANY CHTR’S ACCT 捆扎/加固/垫舱费如有发生,由租船人承担。
12) Lighterage/lightering if any chtrs acct
驳船费/过驳费如发生由租船人承担。
13) Shipside /dockside tally TBF owrs/chtrs acct
船边理货/岸边理货分别由船东/租船人承担。
14) Taxes/dues on CGO/FRT TBF chtrs/owrs acct
关于货物/运费的税费分别由租船人/船东承担。
15) Fumigation:fumigation if any to be for chtr’s acct. owr allow 24hrs for fumigation, chtr should compensate owr usd1500 for crews hotel/traffic/ accomodation charges.
熏舱:如果需要熏舱的话,由租船人承担熏蒸费用。船东允许熏舱24小时,租船人需补偿船东usd1500,作为船员食宿交通费用。
16) Dispute to be settled by arbitration in hk and english law to be applied.
如有争议,在香港仲裁并适用英国法。
